Victim of a Fraudulant Restraining Order Seeks Information
I am a single father with two children,aged 15 and 12. In September of 2002 the 3 of us were living with my girlfriend and her 3 children in Her house. I did not get along with her children or extended family. An argument during which I made no physical attack (nor had I ever done so) led to her aunt calling the police. I had given her all of the money I had in my savings to pay her property taxes which were 3 years in arrears. She filed (and has since admitted as much) a restraining order, the contents of which made me look like Slobadan Milosovich's idea of a super-hero. She did not show up to the first hearing and had to be dragged into the second. Before I go too far, is there any recourse at my disposal to recoup the devastating losses which myself and my children have suffered?

Small claims courts in NM are the place to resolve money disputes such as you describe. Metropolitan Court in Albuquerque; Magistrate courts elsewhere. They will help you with forms and how to file. You can sue for up to $10,000.00.
