Legal Question in Real Estate Law in New Mexico
I am being evicted for unpaid rent because the landlord has not been keeping up with their end of the lease. I have some repairs that need to be done and according to the landlord, the last tenants were kicked out because they trashed the house. Well I have roaches in the house all of time, they have done nothing, I want to get out of this lease as soon as possible, what can I do. If I get evicted, does that prevent me from renting another property?

Many landlords will not touch you if you have an eviction on your record, unless you have a very high income. Like six-figure income. You should go to court before the hearing and talk to the clerk about what it takes to have the Health Department come out and inspect the vermin infestation. You likely will be able to bust this lease due to "constructive eviction." If no self-respecting person would accept a substandard roach motel, then a court will not either AS LONG AS YOU ARE NOT THE REASON FOR THE ROACHES. You want the health dept to see a home that is clean and still overrun by roaches.
