If you owned it before your marriage, and your spouse is not on the title, and you did not give your spouse a gift or an interest in it during your marriage, and if your spouse did not make significant contributions to the mortgage or improvements to the property, then you can probably keep it. Otherwise, it is community property and will have to be negotiated in a property settlement agreement along with your other assets and liabilities.
