terminating a real estate contract

Can a real estate conytact in new mexico that has been in default , be terminated without going to court.

Yes, if it remains in default, but if the resident refuses to move then going to court is required. The escrow company is usually instructed to return the papers to the seller when it determines that a default has occurred and the time to cure it has passed.
