Legal Question in Traffic Law in New Mexico
I'm on my second set of interrogatories with no counsel
I was involved in an auto accident which was not my fault, but I had no insurance at the time. An insurance company is sueing me for $30,000 which I do not have and I have been using the library/internet to figure out how to deal with this. I received a summons 2 years ago and now am on my second set of interrogatories. I recently moved, am I obligated to let them know I've moved? I have literally NO assets, I am a student, I have no financial means to pay this money. I want to know if they can come to a judgement against me if I don't answer the second set, I don't remember a lot of the things they want to know (ie: how fast, how long, how much distance between, etc), should I settle? It is very hard to get anyone to talk to me about this b/c all lawyers want to be on the plaintiff's side as well as most also represent insurance companies. The plaintiff was fine at the scene of the accident and did not go to the hospital, then claimed thousands of $ of medical injuries. ?Please respond.

Re: I'm on my second set of interrogatories with no counsel
You must either settle or continue meeting the requirements of the litigation. If you abandon it now they will enter a default judgment against you for the amount the Plaintiff claims together with court costs.
You may not have any assets now, but what about 10 years from now? Will you then? The Judgment will still be hanging around waiting for you to succeed.
Deal with it now as best you can. Answer the interrogatories to the best of your ability and forge ahead.
If it is a bogus claim that will come out in time.
