My brothers attorney in a probate case is also the probate judge is this possible?

Well of course it's possible, as apparently that is your situation. But is it ethical? No. There is an overwhelming conflict of interest between the two positions, and no responsible attorney would put him/herself in that position. Contact the State Bar of NM if you have a grievance.
