Legal Question in Wills and Trusts in New Mexico

house title

my father passed away 20+ years ago in New Mexico

my mother never probated his will

the will left everything to her and she felt it unnecessary

the title of the house (paid off)is still in my fathers name

does the will need to go thru the probation process to get the title changed over to my mother?

if the answer is yes, can this be done ourselves, or does it require an attorney??

if the answer is no, do we need a quit-claim deed or some other legal aide, or is this a matter for a title office???

all other facets of the estate have been handled--accounts,autos,stocks,etc

Depends upon where the property is located.

If in Texas, you could enter the will as muniment of title. You'd need an attorney that practices in the county where the property is located.

If in New Mexico, you'd need to contact a lawyer in New Mexico.
