What is Probate and why is it necessary?

Probate is a court oversight process in which an impartial Judge ensures that the assets of the deceased are accounted for and distributed according to the directions contained in the will. It is not in fact necessary, but when it is indicated the purpose is to protect the assets of the deceased from fraud. It is designed to make sure the will is not a fraud, and that the people who claim to be the heirs are legitimate. In a nutshell.
