Legal Question in Wills and Trusts in New Mexico

Trustee is not acting

My mother died in early Nov. 2005. My brother is the trustee of her living trust. Its a simple trust, I was there when it was set up. Its involves just him and me. CD,s, an anuity, bonds and a house. We split everything 50/50 with him getting the house, which is fine with me. Trouble is since Nov., basicly nothing has happened. He lives in the house. He will not take any offers of help. He is very closed lipped if I ask him a question. I don't want to make things worse but at some point I believe I'm going to have to do something. I just wonder at what point I should think about a lawyer.
