Legal Question in Wills and Trusts in New Mexico

Wills

My Grandma pasted away in New Mexico. She has no Will but has talked about her wishes with her two daughters and her boyfriend. Is there any way that that will be enough for the state?

Sorry to hear about your grandmother's passing, and unfortunately, the answer is Probably not. You might want to repost your question in the New Mexico section as us CA attorneys are not versed in NM laws, but in CA, it would not be sufficient, the estate would have to go through Probate.

In California, that would certainly be ignored as if you do not state in a will what is to happen, then your assets are handled according to the statutory line of inheritance. I would be surprised if any state did not follow ths rule, as normally the statute wil read, "in the absence of a will" or words to that effect.
