Legal Question in Personal Injury in New York

my 8 year old daughter sliped on a mat leaving a place of bussniss recived 20 sticths in her cheek. what should i do? she is also a identical twin.

I'm terribly sorry to hear about your daughter's accident and injuries. Well first of all, is there a police report prepared or was EMS called to the scene and was a report prepared. If not, was an internal report prepared by the place of business where your daughter fell? Next, what was the cause of the fall? Simple accidents are not enough for a claim to be brought. The business owner, property owner or others have to be culpable (negligent) is their conduct in order to have a viable claim. Your daughter's injuries are serious enough where satisfying the serious injury requirement should not be the most difficult issue. The most difficult issue will be showing that the "defendants" were negligent some way and that they had notice of this condition, whatever this condition is, and failed to remedy it within a reasonable amount of time.

What about the mat caused the fall? Was the lip curled up or something else. You must show a negligent condition that the owner either created or had actual or constructive notice of. Take pictures of the mat if you have not already done so and take pictures of your child's face. I am a former federal and State prosecutor and have been doing accident cases for since 1997.
