Legal Question in Family Law in New York

My 24 year old son is is an abusive marriage. He is emotionally and physically abused and takes it because of his 2 children. He's afraid if he does anything to end his marriage he will lose his kids somehow. What should he do first?

1. Counseling: because he has made 2 babies with this person, he owes it to himself and the children to at least try counseling.

2. If #1 fails, see a lawyer and express his concerns.
