Re: criminal history check
Sorry, but your past is not a secret. You'd be surprised how easy it is to get this type of information. But you had better believe that unless there is some problem with the computers in Albany, the judge is going to know about all of your past convictions and even some of your arrests that may not have resulted in convictions.
But just for the heck of it, let's say there IS a computer problem and they don't have your sheet on hand. There are far too many stories from the past of judges and law enforcement officers who decided to take action and make decisions without the full rap sheet - only to find out they had just released a hard-core criminal who had been sought by officials, or who went on to hurt someone. So nobody takes chances anymore. They are highly unlikely to make a decision without all the info in front of them.
Obviously I don't have all of the fact for your situation so please do not take this as legal advice that I have given based of a careful assessment of your circumstances. It's just an off-the cuff lay opinion. But if you'd like to come in for a consultation, please let me know.
Good luck.

Re: criminal history check
Generally, the judge will at the very least have your criminal history within that particular county, usually within the state, and sometimes even out of state if there are any open warrants or anything along those lines.
