Legal Question in Criminal Law in New York

criminal history check

I need to know if when i go to town court for petit larceny for my first appearance, is the judge gonna have all my criminal history background?or is it possible that i will just get a fine? because i have more petit larcenies on my record.

Sorry, but your past is not a secret. You'd be surprised how easy it is to get this type of information. But you had better believe that unless there is some problem with the computers in Albany, the judge is going to know about all of your past convictions and even some of your arrests that may not have resulted in convictions.

But just for the heck of it, let's say there IS a computer problem and they don't have your sheet on hand. There are far too many stories from the past of judges and law enforcement officers who decided to take action and make decisions without the full rap sheet - only to find out they had just released a hard-core criminal who had been sought by officials, or who went on to hurt someone. So nobody takes chances anymore. They are highly unlikely to make a decision without all the info in front of them.

Generally, the judge will at the very least have your criminal history within that particular county, usually within the state, and sometimes even out of state if there are any open warrants or anything along those lines.
