Legal Question in Criminal Law in New York
My daughter is in the New York Drug court program. On Nov 22 she was incarcerated in the suffolk county jail. This to the amazement of her probation office. Today in court the DA asked that she be released. The judge refused. Because this is drug court may we still file a Writ of Habeas corpus .

She can always file a Writ but whether it will succeed or not is another question. The Judge does not have to go along with the DA. There must be some unusual circumstances here.
