Re: documents needed

There are at least two separate forms involved in the process of adjustment of status based on a marriage to a U.S. citizen -- petition for alien relative or I-130 (filed by your spouse) and your Application to Register Permanent Residence or to Adjust Status or I-485. There is also an Affidavit of Support required. You can find the forms and the requirements for supporting documentation on the website of USCIS -- immigration authorities at http://www.uscis.gov.

Depending on what you mean by "being out of status," you may or may not be eligible for adjustment of status. Certain admissibility requirements apply even if you married a U.S. citizen and initially entered on a valid visa, though simply overstaying your visa period is unlikely to present a problem. You should verify that you qualify for adjustment of status and do not require waivers for any immigration-related violations before you submit any documents or forms. Good luck.

Re: documents needed

You need to provide more information than you currently have, for ex.: when were you married, are you applying for permanent residency, do u have a green card, a visa? etc. Although very confusing to figure out without the proper experience, here's the webiste where you can find INS forms if you want to try to figure this out on your own:

I am able to help you if you find the process overwhelming and burdensome.
