Legal Question in Family Law in New York

Leaving state with my child

I am divorced and my daughter lives with me. There is no court order about custody of our daughter. I am allowed to legally move out of the state of New York with my daughter without getting into any kind of trouble? I don't want to move, then be arrested for kidnapping.

Re: Leaving state with my child

I cannot advise you adequately based upon the facts that you provided. I suspect that there is a custody order within your divorce judgment that you may have inadvertently overlooked. I would need to review the divorce judgment/stipulation of settlement and/or separation agreement to advise you appropriately.
