Legal Question in Real Estate Law in New York

A few months ago we hired a buyer's agent. She worked with our mortgage representative to figure out exactly the home value and taxes that we can afford when buying a house. She then double checked the taxes on the houses she was taking us to before showing us the houses. We placed a bid, signed a contract, got an inspection, etc. yesterday, the underwriter called and said that the taxes are 2 grand higher than we were led to believe, and we cannot qualify for the mortgage. Can I hold the buyer's agent accountable? We never would of done an inspection/signed a contract on a house we cannot afford.

It would depend on where she got the tax information. She probably got it from a listing or the sellers. So the answer is, probably not, unless she made them up to induce the sale, perpetuated some kind of fraud. Aside from that, mortgage denial based on tax information is odd. You can see the amount of taxes by searching public records on the city website. Or asking your attorney.
