Legal Question in Criminal Law in New York

Hi! My mother was caught shoplifting at JC Penny. She stole 15 items including clothing and jewerly. My mother has a clean record. This is her first time being charged with something. I am very scared of what the judge will have her do. Will she have to go to jail, pay a fine or both? Please help. Thank You

Your mother will probably not go to jail; although she is facing criminal charges and could end up with a criminal record. The seriousness of the charge depends on the value of the stolen property. Depending on whether you have legal aid or a private attorney, the less serious cases can get negotiated to a lesser charge and the payment of a fine.

If you are thinking about hiring a lawyer for your mother, you should do so immediately so he or she can begin working on the case. If you are not, make sure that your mother gets to court early and explains to the public defender exactly what happened. If an attorney has already been assigned to the case, make sure your mother contacts the attorney and finds out what they prosecutor's position is on this case.

I agree partially with the previous answer. Your mother is facing criminal charges which potentially carry a jail penalty as well as a permanrent criminal record. The value of the stolen goods determine if the charges are a misdemeanor or a felony, this greatly impacts the result.
