Legal Question in Criminal Law in New York
I recently applied for a job. They ran a background check which pulled up an open warrant from 1998 that I knew nothing about. The warrant is from NY for a summons that was issued to someone using my name (not me!!). When I did not appear for the court date on the summons, the warrant was issues. I have now live in FL and am out of work. I don't know how to get this matter resolved so that I do not have a criminal record. The court has no information as to a citation or summons number or even what the charge is for. Do I have to go to NY to resolve this? Do I still have the right to defend myself against these charges even though I did not appear at the inital court date (which I did not even know about)? Can I get the case dismissed?

Since it is only a minor charge, an attorney may be able to handle the case without you being present, but depending on any description that might fit you, you may at some time be required to appear, but I doubt it.
