Legal Question in Credit and Debt Law in New York

Statue of Limitation & Wage Garnishments

I had a judgement put against me. I didn't appear in court because I didn't know of the court date. Bank account now frozen. I am afraid they will now try to garnish my wages.

I have paid nothing or heard nothing on this account since 2000. What should I do now? Contact the court? I do not want to pay anything on this account because I dont believe I owe the debt. Can I stop wage garishments? Thanks for the help.

Re: Statue of Limitation & Wage Garnishments

There are a variety of options that might be available to you. You might be able to vacate the default judgment but that will depend on the specifics of your case, for ex.: whether your default was excusable and whether you have a meritorious defense in the underlying matter.

You may contact me at (718) 238-7444 with any further questions.

Re: Statue of Limitation & Wage Garnishments

There are time limits but I cannot know what they are becasue they are fact specific. Go to court and ask for help as a pro se defendant and try for an Order to Show cause to vacate the Judgment and release the restraint.

Good Luck
