Legal Question in Disability Law in New York

My 18 year old daughter got caught shop lifting $35 work of items. She was with her grandmother at the time. My daughter has autism and was asked to sign some papers. we have rec'd an attorney letter requesting $160 in a civil demand to settle this. What is my responsibility as her parent. The child admitted she was looking for attention from her grandmother who was ignoring her.

The attorney is threatening a civil suit against your daughter; however, your daughter may not have the capacity to sue or be sued within her own right. My advice is to write to this attorney and let him know that your daughter is autistic and if pursues a claim on behalf of his client you may be required to get and attorney and seek reimbursement of your fees and expenses.
