Legal Question in Disability Law in New York
Is Adult Attention Deficit Disorder Recognized as a Disability?
I have been diagnosed and am under medical treatment as a case of Adult ADD. Job changes have vastly increased the quantity and scope of my tasks at work, compounding the difficulty I have with this. Per recommendations of my medical provider and the literature on this subject, I have explained my condition and asked for accommodation to be made at work -- mainly by job restructuring (revising workload distribution and the like). One of the people in my department has even volunteered to take on more of my tasks. However, the basic response from my management has been, ''find ways to organize better'' -- which is somewhat like asking a blind person to try to see better!
The workload is becoming overwhelming, with my overtime (unpaid in this salaried job) exceeding all other salaried people. It looks like the only way to ''get a life'' in this situation is to get a lawyer! Does this situation seem to constitute discrimination against a disabled person? (I should add, I am near to retirement age, but not financially ready to call it quits!)
