Legal Question in Disability Law in New York

Handicapped Parking Spaces

Is a handicapped parking space still a handicapped parking space in a private lot for a store / shopping center that has been closed for three and a half hours (11:30 pm)? It obviously provides no benefit to a handicapped person for which it was intended.

Re: Handicapped Parking Spaces

This is not a philosophical problem like, if a tree falls in the forest and no one is around, does it make a sound?

Of course the handicapped space is still reserved for the Handicapped. Does it have a time limit on it, like alternate side parking? No. Does it say " only sometimes for the handicapped? " no. It clearly delineates that if the handicapped, for whom the space is reserved, want to sleep in it until the damn store opens, or park in it while having a tailgate party, so be it. IT IS A HANDICAPPED RESERVED PARKING SPACE. Do diplomatic spaces become available to you when the U.N. is not in session? Pay the ticket and learn your lesson. Handicapped spaces are for the handicapped.
