Legal Question in Disability Law in New York

Lawyer

My brother has a disability claim currently pending with the court and has an upcoming trial. His lawyer is not returning his telephone calls and the law firm is avoiding all of his messages. Can we bring this to the attention of the judge & fire this attorney while also requesting a postponement from the judge until we are able to hire a competent lawyer??

You don't need the court's permission to change lawyers, but as you correctly point out you will need the court's permission to get an adjournment so that you can hire an attorney whom you are more comfortable with. Do you have a trial date yet?
