Legal Question in Administrative Law in New York

my neighbor said he putting up a fence down the property line so i had it surveyed and he still placed his fence onto my property by up to a foot. 1. can I remove the fence over the line fence? 2. How do I make him remove it for he says it's to bad?

Give him a formal notice (certified mail) that he has encroached on your property and that he is to move the fence back to his property line. If he refuses, then file suit to eject the trespasser.
