Legal Question in Administrative Law in New York
I received a letter from the New York State office of Children & Family Services informing me that according to their records, I am the "subject of an indicated report of child abuse and/or maltreatment".
Listed at the top of the letter, is the name of the requesting agency which happens to be my employer, a school for disabled, special education children. I immediately took the letter to my employer since I am not aware of any such allegations against me. After reviewing the letter, the superintendent of the school did not know of any such report requested by the school and in fact gave me a copy of the most recent (2 YRS. old) background check conducted by the same agency named above, which gave me a clear record.
Can you help me figure this out? The superintendents guess is that, it must be a mistake and/or someone, maybe a neighbor, has filed a complaint against me. But, that still doesn't explain why the letter states the requesting agency as my employer.

Do not freak out. You have contacted your employer. They are not aware of any misconduct. My guess is it may be the parent or guardian of one of the children under your care or maybe even a co-worker. It may also be regarding your own children, if you have any. It can hardly be a mistake. Contact the agency and the contact number of person who is the agency investigator and request information. Agree to meet with them, but say little if you figure there is more at stake than meets the eye. Upon gathering information and obtaining a gut feeling regarding your status, you may then decide to confer with an attorney.
