Legal Question in Administrative Law in New York

Summons for Open Container

A buddy (drivers seat) of mine and myself (passenger seat) both received a ticket last night at Yankees stadium for having an open container of alcohol in a parked car in a public area.

A few questions:

1) I was in violation of 10-125 2D, where can I find out what the offense is? Does this stay on my permanent record? And how much of a fine should I expect for this? The cops said it would be $25. Does that sound right?

2) My buddy's violation was 10-125 2B, what offense is that? And why would we both receive different violations? Also they checked the box ''Motorist Exhibited Licence'' to yes. Mine wasn't checked off at all.

3) Neither of us had to sign the bottom acknowledging we understood the offense, did we need to?

4) Is this a case worth fighting and getting a lawyer for? I don't mind paying the fine if it's small but I really don't want it sitting on my record.

Let me know if you need any more information from me. Thanks in advance.

Re: Summons for Open Container

The offenses charged are both violations, which will have little or no effect on your record. They generally involve the payment of some fine and nothing more.If you feel more comfortable being represented by an attorney I can be of assistance, you may call my office @718-834-0087 for more information.
