Is falsifying timesheet records a misdemeanor or a felony if charged?
Can the company expect retribution from the employee?

Shorting an hourly employee's hours by an employer is a VERY serious matter and the employer should expect a world of pain if it can be shown that it was done with intent to cheat the employee. The employee most certainly has a claim. If you believe you've been shorted on your hours by an employer you should consult an attorney right away. Assuming it was the employee who falsified the timesheets, s/he can expect to be discharged from employment.
