Legal Question in Appeals and Writs in New York

Appealing a lawsuit

My Brother was in a very serious accident where his passenger almost died and my brother suffered a head injury and had to have surgery on his shoulder and may need another surgery on the same shoulder in order to move it.He recently went to court for this and it seemed that the Lawyer, doctors and other witnesses really made a sound case that he in deed suffered injuries from this accident. But the Jury ruled that although he had surgery and a concussion that he didnt deserve any money and they awarded nothing but disappoinment. My question is After losing this case with so much evidence can he find a way to go back to court and atleast recieve compensation for his pain and suffering. No one in the court room including the judge believed that the jury would have make such a decision. After all the other side admitted guilt and by saying they ran the redlight and struck my brothers car.

Re: Appealing a lawsuit

Your brother can make a motion to the trial judge to set aside the verdict as being againg the weight of the evidence. If that fails, your brother can take an appeal on the same grounds.

I assume that your brother's lawyer will do these things. However, if you wish to discuss the case, please feel free to call me at (212) 622-7180.
