Legal Question in Appeals and Writs in New York

Get copy of original notice of appeal documents

Is it possible to get thru the Freedom of Infomation Act or some other way a copy of the original documents filed with a Notice of Appeal. For example a copy of the pre statement, notice of entry of judgement or decision etc.?

Re: Get copy of original notice of appeal documents

You can just go to the file room of the court in which the notice of appeal was filed. Ask for the file in the case. Bring money so you can make copies on the court's copy machine.

Re: Get copy of original notice of appeal documents

If you are the opposing party, those documents should have been served on you or your attorney when they were filed. Otherwise, they should be publically available as part of the lower (not yet appellate) court's case file, obtainable by visiting the clerk's office. There should be no need to invoke the FOIA.
