Legal Question in Appeals and Writs in New York
Notice of Entry
In Civil/Kings I was granted an Decision in my favor. I inquired with the Court clerk if I need to file a Notice of Entry, and was told that since it was not specified in the decision I did not have to do so. Now, two months later, defendant's attorney sent me a Notice of Entry and a Notice of Appeal. can he do that? what can I do?

Yes. The 30-day period to file a Notice of Appeal does not start until someone serves the order with notice of entry.
