Legal Question in Appeals and Writs in New York
Yesterday I was in small claims court regarding a boiler that was installed in my home and has never functioned properly. I paid the company half upfront and I am withholding the other half because I have to pay someone else to fix the mess this company left me with. The judge seemed biased towards the business owner and would not let me bring in any of my audiotape or videotape evidence that provide clear proof that the work was shoddy and the company knew it. (I even have on tape that they told me they were going to have to call the boiler manufacturer because they couldn't figure out how to fix what was wrong.) I brought estimates and pictures that the judge did look at, but he seemed to not only accept the business owner's lies and excuses, but he also offered up excuses for him. I have to wait a month for the judge's official decision but it felt like he had already made the decision before I entered the room and wasn't going to allow me to present any evidence to the contrary. I know it is only small claims court, but do I have any rights if I feel like I did not get a fair trial?
