Legal Question in Banking Law in New York
Capital one bank closed my savings and checking accounts permanently, They told me they would send me a check Jan 10th 2024, and told me it would take about 10 days maximum. I have called them several times since it's been over a month now but they just tell me to wait. Now They voided the check since I never received it and in order for them to reissue me another check, they want me to sign an affidavit stating that the check was lost or stolen and in the last part it says that I will not hold them accountable for any loss. I have to sign it and notarize it, but what if the check does not come again, then they won't be responsible? What should I do ? They won't give it to me unless I sign that affidavit
