Legal Question in Bankruptcy in New York

Behind on 2nd mortgage

If I am making my 1st mortgage payments on time every month but am behind on my 2nd mortgage which is a home equity line of credit, what will happen? Will that bank issue a lien against the property or will they foreclose on me. Also, what about credit cards or unsecured debts, can they do anything to your property?

Re: Behind on 2nd mortgage

Unfortunately, I can't tell you what the bank WILL do. The bank does, however, have the option of foreclosing on your property if you do not satisfy your obligation to them.

With credit cards or unsecured debt, they first have to obtain a judgment against you and then they can take certain steps to satisfy that judgment, such as placing a lien on the property.
