Legal Question in Bankruptcy in New York

ammending a bankruptcy

I filed for bankruptcy in october 2005...all debts were dissmissed in december of 2005. I had a promisary note for $4900 which i totally left out. I was recently taken to small claims court for the promisary note and gudgement was for the plantiff. Is it still possible to amend my bankruptcy to include the note. I filed on my own so i am not sure as what to do at this point. I do not have the money to pay this debt..as i am just getting back on my feet.

Oh, dear. This is why we lawyers keep telling people to HIRE A LAWYER.

You're in a tough spot. It may be possible to amend your petition, but it may not. Bankruptcy is a complex process that can completely screw the debtor to the wall if s/he doesn't follow the rules -- and people representing themselves generally don't know the rules. Without seeing your petition and having background in the case, your question is hard to answer.

HIRE A LAWYER, have the lawyer go through your bankruptcy petition and records with you, and see where you stand.

You need the help of a legal professional with this one.

If you can't afford a lawyer, you might try contacting the Legal Aid society in your county (every county in NY State has one). If you are income-qualified, they can handle your case for no fee or a reduced fee.
