Legal Question in Bankruptcy in New York

Bancruptcy Dismissal

Hello, Several years ago I file a chapter 13 and was unable to make payments to the plan. I waited and applied again and was paying payments to the trustee. I lost my job and the chapter 13 was dismissed. My home was included in the bankruptcy. The home was forclosed and sold for the value of the home and what was owed. I recently returned from Iraq and did a free credit report on myself. I noticed that the bankruptcy was on there and so was something from the attorneys who represented the mortgage company in the amount of $114,000. Now can they legally make me responsible for this money and still collect money for the sale of the home. It seems like their trying to collect double the vale of the home. Please help me.

If the mortgage was paid off by the sale, then you owe nothing, if it was nit, then they still can't sue you for the Remainder in New Yor, without Court Approval First.

You may want to file a Chapter 7 to get rid of any debts that you owe.
