Legal Question in Bankruptcy in New York

bankruptcy chapter 7 how does it affect an inheritance

My Dad passed away in 2004. he had a cabin worth $20,000. if the cabin was ever sold the grandchildren would recieve the profits, there are eight grandchildren. My son filed for bankruptcy in 6/07. We just sold the cabin and he is entitled to 1/8th of the monies from the sale approx $1700. Will this have to be turned over to the bankruptcy trustie?

I hope your son had an attorney file the bankruptcy petition. If he did, that attorney needs to be made aware of the sale of the property and the proceeds to which your son is entitled. If he did not have an attorney file the papers for him, he needs to hire one NOW.

Do NOT decide that you can save a buck and jolly a Chapter 7 Trustee along on this without professional help. Your son needs a lawyer representing him.

Good luck.
