Legal Question in Bankruptcy in New York
Bankruptcy and Judgements
I recently had two judgements filed against me, as a result my checking accounts have been restrained and my salary has been ordered to be garnished. I do not have any extra money to pay either the judgements or the garnishment every week. I would like to know if claiming bankruptcy will help me rid this debt and help me restablish new credit in the future? I would also like to know which Chapter is best to file in this case?

Re: Bankruptcy and Judgements
This is a difficult situation. Yes, Bankruptcy can help you. The correct Chapter is likely 'Chapter 7', but a repayment plan can be established under 13.
Bankruptcy will eradicate the debts. The creditor will no longer be able to take any action to collect on the debt. On the other hand, the bankruptcy will not help your credit rating (although you will be bombarded with credit card applications the day after the bankruptcy petition is approved!)
I work in this area and would be happy to discuss your options with you. You are welcome to a consultation for no fee at my offices at 42 west 44th street, NY,NY. Please call for an appointment first (646) 591-5786.
Re: Bankruptcy and Judgements
These judgments - as you have described them - can be eliminated in Bankruptcy and your checking accounts can be freed up again fairly quickly. It sounds like a Chapter 7 is ideal for you but I would need to review your entire situation in detail. You are welcome to call toll free at 877-832-2376 or 212-745-1373 for a free telephone consultation or to make an appointment to come to my office.
