Legal Question in Bankruptcy in New York

bankruptcy/stimulus package

With all the talk about the ''stimulis plan'' helping certain individual keep their homes and avoid bankruptcy...what about those of us that filed chapter 13 in 2008 to avoid loosing our homes, is there any help for us? Things are no better having filed, worse now it's like paying 2 mortgage payments. I can barely afford food as a single mother with a 1 full time job and a second part time job there doesn't seem to be any relief for me. Am I out of luck?

I sympathize with your difficulties.

However, nobody has an answer for you yet as there is various pending legislation that may or may not be enacted. At this point, it is up to the Senate to vote on the proposed cram-down provision, and if they pass it, it would then go to a committee to prepare the version sent to the President.

Then, once the law is enacted, thre is an issue as to whether you might be able to take advantage of it.
