Legal Question in Bankruptcy in New York

Do the beneficiary of the debtor liable for the money he owe?

My husband filed a chapter 7 bankruptcy. He did not include my name as his wife. Am I liable to pay for the money he owe? The court decision says that the beneficiary of the debtor should not be held liable for the money that the debtor owe. My husband requested for additional credit card he put it on my name .But this additional card was never activated there was never any single transaction that I made. The credit card company is forcing me to pay for the money my husband owe because I am the secondary card holder. How does the final court decision will protect me. Please I really need your help.

Re: Do the beneficiary of the debtor liable for the money he owe?

Because you did not also file Bankruptcy

the Order of Discharge is of no help to you

If you are liable, it must be because you

either signed the original agreement with

the Company or actually used the card. this

can be difficult to prove to the satisfaction

of the credit card company, but if you did

not sign the original agreement and you never

used the card, it is worth the effort
