Legal Question in Bankruptcy in New York

car accident

i was in a car accident. i was hit from behind at 70mph.i received several fractures and i had 4 dic in my neck fused.i have a law suite against the driver .my question is that i claimed bankruptcy due to the accident but my bankruptcy was discharged in march of 2002.when my settlement is awarded does the bankruptcy get the settlement.the whole settlement is greater than what i owed. Do they have any right to any of the settlement.if yes are they only entitle to what my bankruptcy was for.

Re: car accident

Yours is a very fact-specific outcome, and I don't have all the facts. Therefore, I'm going to kick this back to you and tell you that you need to take the situation to an attorney who is local to you and ask about your fact-specific rights. Your county's bar association may have a referral program in place, or the New York State Bar Association certainly does (www.nysba.org).

Good luck.
