Legal Question in Bankruptcy in New York

Collection agents

I received a call today from a collection agent, regarding an unpaid bill from 2002. Basically what happened is in 2002 I viisited a hopsital on a sunday because I was not feeling well. They gave me a blood test and prescribed a medication. I was not too confident in their diagnosis so the next day I visited my regular dr. who told me they gave me the wrong test, and the medication the prescribed could have actually hurt me. I sent letters to the hospital and the dep of health at the time arguing the bill because I had to pay for all new tests the next day. Being that this was over five years ago I can't remember the exact outcome of the letters, but I do know I spoke to the dep of health who agreed the hospital acted improperly and that someone from the hospital finally followed up saying that the bills would be dropped. Of course I do not have this info still being that it was over 5 years ago. My question is, does the collection agent still have the right to persue these charges that are so old? If they do, should I just settle to make this go away? They are threatening me with putting a collection against me which would be reflected in my credit report. Thank you!
