Re: Cyber Rebate Bankrupcy

The first thing you should do is to file a "Proof of Claim" with the Bankruptcy Court. This is simply a statement of what you are owed. Ther is an official form for this. The reason a company files a Chapter 11 is to allow it to continue doing business without being burdened with debt. Therefore, the Court will expect the company to develope a plan to pay the debt off over time which is within the companys means. Usually this means that only a portion of the total debt is paid. Secured creditors have priority in this plan. You appear to be an unsecured creditor. Therefore, there are probably many other creditors standing in line in front of you. You may be able to get some percentage of your money paid over time under the plan. But first submit a "Proof of Claim". Of course, everything depends on what stage the Bankruptcy is in now. Once a plan is confirmed by the court a creditor generally cannot be added if they failed to file a proof of claim on time. Contact my office in New York if you have further questions.
