Legal Question in Bankruptcy in New York

What do I do about my debts?

I have a part time job. I do not get paid until January because of their billing cycle. What I receive, half goes to my car and insurance. I already have a judgement against me for a credit card debt. I have no way to pay it at this time. I am still looking for day employment. Will bankruptcy help? How can I afford the fees when I literally have no money?

A second question: I have a shared bank account with my sister. My account was garnished because of her, credit card debts. How can I retrieve that money. It was all mine?

This is a difficult situation.

1. Whether Bankruptcy is right for you depends on how much you owe, whether you can protect important property (car), and your income.

If you owe less than twice your annual income, then you should talk with a lawyer or other person about whenther bankruptcy is right for you. maybe it is, but talk before you make a final decision.

My fee is 500 for a CH7 Bankruptcy (the kind you would do) and I can offer a consultation for no fee.

2. Even though the money in the bank account was put in by you, it was legally owned by both of you. What the creditors already have, they will keep. Your friend is the one who must pay you back.
