Legal Question in Bankruptcy in New York
Can I file bankcruptcy without my spouse
I borrowed money from credit cards and friends to meet margin calls for the stock market account. Eventually, it almost 90% wiped out, now left over about $5000.00.
It is a joint account with my spouse.
Credit cards are my personal not joint.
We do not have any asset or property.
We filed joint income tax.
Can I filed bankcruptcy without involving my spouse.
Your answer would be highly appreciated.
Thank you.

Yes you can. I need to know a few more facts to make sure your wife won't be forced into bankruptcy by the creditors committee.
