Legal Question in Bankruptcy in New York

Where should I file bankruptcy

My employer quit paying me, but

promised to pay if I would just ''hang

on a few more weeks''. A few weeks

turned into many months and still I

have no money for all my hard work.

I relocated across the country to

work for them. They also stuck me

with high credit card bills for travel

expenses they said I'd be reimbursed

for ''when the financing closes''.

Unfortunately I bought a house in

New York (in Suffolk county Long

Island) to live in while working for

this dead beat company. I can't pay

the mortgage and I'm up to my

eyeballs in debt.

My wife and I want to divorce. I took

one daughter and moved to Texas -

my wife took the other and moved to

Missouri.

I need to declare bankruptcy and

move on so that I can file for divorce

in Texas when the 6 month

residency requirement is met.

I'm guessing I need to file for

bankruptcy in New York because I

haven't been in Texas long enough.

I need to find a new york bankruptcy

attorney who won't cost me a

fortune in additional legal fees. How

can I compare prices without having

to call and call and call?

You will qualify for filing in Texas, your new home state, once you have been there at least 91 days.

You don't indicate any reason why you would need to rush to file. It is unlikely that your creditors can do anything against you in Texas before you file anyway. I suggest you wait it out, which is probably just a few more weeks.

Although I am a Suffolk County bankruptcy attorney, I think you'd be better off waiting a few weeks; otherwise, you'd have to fly back here for your hearing, which would have to cost you a fair amount.
