Legal Question in Bankruptcy in New York
filing a civil suit against a bankruptcy fraud
I want to sue in civil court. I have information showing that the debtor lied about his income in a ch 7 bankruptcy. The bankruptcy harms me. Does the civil case have to be conducted in the same state the fraud is perpetrated? What kind of lawyer would handle this type of case?

Re: filing a civil suit against a bankruptcy fraud
I'm not sure if you can just sue in some other court, I doubt it. Normally, you would be required to vacate his discharge, on the grounds of fraud on the bankruptcy court. As a first step, I suggest you report your information to the Office of the U.S. Trustee which was responsible for the case, and/or the US Attorney for that district. They may take some action.
