Legal Question in Bankruptcy in New York

Financial INcompeence

My brother filed banruptcy a few years ago. Unfortunately for me both our names are on the deed. Right now and for several years he has been giving me less than his portion of the mortgage. With the large increase in property taxes in nassau county,i have been demanding for him to give more. it has come to my attention he is not always paying his banruptcy obligations, yet still does not have money to give towards the mortgage. is there some way to declare him financially incompetent and have him removed from the deed? i would assume responsibility for his finances. I am concerned about losing what i have invested. I have been paying for all repairs and improvements in the house for the last 10 years.

Re: Financial INcompeence

This problem can be solved. The bankruptcy decree iwill let you know what tools are available. If the property is not listed in the decree, then your options are simplified.

You are welcome to a consultation for no fee (but bring the bankruptcy petition and decree).
