Legal Question in Bankruptcy in New York
Good morning, I wanted to know if I need a lawyer to file bankruptcy? I currently owe Bout $15,000.00 in debt, (round it off). I make $1439.00 before taxes, $1092.00after taxes including a 10% garnishment of my pay. I am currently in judgment with three different collection agencies/ lawyers offices. Once one garnished order ks paid off I have anotber in line. All together about $7000.00. At this rate I will never finisb paying these plus my other bills. What should I do?

Having an attorney in a bankruptcy matter is definitely a good idea. You, however, do not have much debt (relatively speaking). You may be able to get a reduced legal fee rate. In my office, we usually offer to reduce the legal fee to $1000 in a case such as yours. It is important to have an attorney so that your personal property exemptions are listed correctly and so that you complete your schedules correctly.
You may be a candidate for Chapter 7 Bankruptcy in which all your unsecured debts may be discharged. This would achieve substantial savings as compared to repaying your creditors through garnishment or otherwise. It is prudent to have an attorney assist you in order to ensure that your petition and schedules are completed properly and that your assets are protected. You may qualify for a discounted fee. I wanted to know if I need a lawyer to file bankruptcy? Anyone can represent themself in a legal proceeding. Having a lawyer will insure that creditors don't try to take advantage of you during the proceeding, and after the case closes
