Legal Question in Bankruptcy in New York

Household size and income

How do they look at household size when you are filing but you live with someone who pays all the bills? I am filing and the person I live with isn't, he pays the rent and utilities, do they count his income or only the utilities he pays?

When I spoke to an attorney, he said that they don't include the other person's income, but I have heard elsewhere that they do.

Re: Household size and income

This is a frequent issue that arises under the new laws. Last year I wrote an article about this to assist other attorneys with helping their clients with this issue. I suggest you look at this article to get the answer to your question. The article, entiteled, "Determining Household

Size for the Means Test," can be viewed on my bankruptcy web site: http://www.bankruptcycanhelp.com/pdf/2007-10-S-Means-Test-Household-Size.pdf
